GENERAL SALES CONDITIONS

Fogacci Group Srl, with registered office in Castel San Pietro Terme (Bologna), Bologna Companies Register No. 02332531207, is the owner of the site https://www.fogacci.com.it, and of the brand Fogacci Vapor Control. The product offers presented on the site are valid, subject to availability, exclusively for the countries indicated at the time of the order confirmation. Not being able to guarantee the perfect representation of the products on the site, in particular due to differences in the rendering of colours by internet navigation software and display hardware, Fogacci Group Srl cannot be held responsible for the inaccuracy of the photographs appearing on the site. There may also be differences between the products delivered and those represented on the site, as the photos are intended to be merely indicative. Such differences, however, since they do not affect the essential characteristics of the products or their quality, do not justify any cancellation of the order, or refusal to accept delivery.

DISPLAYED PRICES

All the product prices are expressed in Euros, excluding shipping costs, which will be displayed before the order is confirmed. In the event of the publication of an incorrect price, the customer will be contacted and given the choice whether to purchase the product at the correct price or to cancel the order. In the latter case, Fogacci Group Srl will refund the amount paid by the customer, excluding any right of the customer to claim any further damages or compensation.

PRODUCT AVAILABILITY

Should an order, even if confirmed, exceed the quantity present in the warehouse, Fogacci Group Srl will communicate the lack of availability within 72 hours and any waiting time for fulfilment of the order. If the customer does not agree with the waiting time necessary for delivery, the contract shall be considered terminated, and Fogacci Group Srl will immediately refund the payment, and any right of the customer to claim further damages or compensation shall be excluded.

SHIPPING COSTS

Fogacci Group Srl ships all over the world, and its shipping costs are indicated when entering the shipping address. Fogacci Group Srl has chosen to keep the shipping costs separate from the price of the product in order to ensure maximum transparency.

DELIVERY TIMES & METHODS

Fogacci Group Srl undertakes to deliver the products within 5-6 working days (excluding Sundays and holidays), from the confirmation of the order payment. Deliveries to post office or post box addresses are not accepted. Fogacci Group Srl ships by express courier (usually BRT Spa for Italy, DPD for European countries, and UPS for non-European countries).
Delivery is made to the street level.

RECEIVING THE DELIVERY

At the time of delivery, the customer must verify that the package is intact, undamaged, and, in any case, conforms with the standard characteristics of a package. Any issues must be raised immediately with the courier, or otherwise the product shall be considered delivered correctly.

Credit Card / PayPal
It is possible to pay by credit card, in a safe and secure way, both with PayPal and with Axerve Gestpay Banca Sella. The connection complies with the strictest certification standards, the connection takes place directly between your device and the payment system you choose. The transaction thus remains private, encrypted and protected. In no way will information relating to your credit card or your account be transmitted to our computer systems.

Advance bank transfer
In the case of payments by bank transfer, the goods will be shipped only after having the payment has been credited to the current account of Fogacci Group Srl. The description of the bank transfer must indicate: the number and date of the order, and the name and surname of the customer. The bank account details and transfer description will be communicated in the order confirmation email sent to the customer. If Fogacci Group Srl does not receive payment within 8 days of receiving the order confirmation, the order will be cancelled.

WARRANTY

All products sold by Fogacci Group Srl are covered by a two-year European warranty applying to any manufacturing defects in products purchased by private customers or consumers, that is, natural persons not acting for any purposes related to entrepreneurial, commercial, craft or professional activities. Any damage caused by misuse or improper use of the products, or any use not in compliance with the instructions supplied with the product, shall not fall under the warranty.

RIGHT OF WITHDRAWAL

Fogacci Group Srl acknowledges that the customer who, for any reason, is not satisfied with the purchase may exercise the right of withdrawal, as per applicable legislation. This right may only be exercised by customers who are consumers. Therefore, this right shall not be exercisable for purchases made for purposes relating to business or professional activities, and associated with a VAT number in the relevant order form. The deadline for exercising this right is 10 working days from receipt of the goods, within which time the customer must return the goods and send notification by registered letter with return receipt to the address: Fogacci Group Srl, Bologna.
To exercise the right of withdrawal, it is necessary that:
• The customer sends notification of the intention to exercise the right of withdrawal in the manner described above;
• The purchased good returned intact, unused and in its original packaging, complete with all its parts (including any documentation and accessory equipment, such as manuals, leaflets, etc.);
• The product is returned within the times and in the manner described above. The delivery costs shall be borne by the customer. It is understood that any transport risks for the return of the items shall be fully borne by the customer.
After verifying the requisites for the right of withdrawal, Fogacci Group Srl will re-credit the sum already paid by bank transfer to the current account communicated to the Customer Care service. The refund shall only concern the price of the product, and will be made no later than 30 days from the moment the goods for which the customer wants to exercise the right of withdrawal are returned.
The only costs to be borne by the customer are those relating to the return of the product.

PRIVACY

The personal data requested when placing an order are collected and processed in order to satisfy the express requests of the customer, and will in no case or for any reason be transferred to third parties. Fogacci Group Srl guarantees its customers compliance with legislation on the processing of personal data, as governed by the Privacy Code referred to in Italian Legislative Decree 196 of 30 June 2003. APPLICABLE LAW

The sales contract between the customer and Fogacci Group Srl is concluded in Italy and governed by Italian Law. Jurisdiction shall be exclusively that of the Court of Bologna.
